Terms of use

1. Purpose

These terms set out the conditions for using the mobile application "Today's Botanical Card" (the "app") provided by studio abitbetter (the "operator"), and the rights and obligations of the operator and the user.

2. Definitions

• "App" means the service in which you look at botanical illustrations, name the plant, and collect cards.
• "User" means a person who agrees to these terms and uses the app.
• "Card" means content made by the operator, consisting of a plant illustration, a photograph, and written notes.
• "Submission" means sending a photograph and its shooting details through the app so that a card can be made.
• "Support" means a one-time in-app payment through which a user supports the operator's creative work.

3. Effect and amendment

• These terms take effect when posted in the app.
• The operator may amend these terms where necessary, and will announce any amendment in the app or by notification.
• A user who does not agree to an amendment may stop using the app.

4. Use without an account

• The app can be used without signing up or logging in.
• Your collection record and settings are stored on your device. They may be lost if you change or reset your device or delete the app; you can guard against this with the backup feature in the settings.
• Keeping your backup code is your responsibility. If the code is lost, the operator cannot restore your record.

5. The service

• The operator aims to add one to five cards a week, but this may vary with the pace of the artwork.
• The operator may add, change, or discontinue features to improve the service.
• The service may be interrupted for maintenance, network failure, or events beyond the operator's control.

6. Intellectual property

• The operator owns the copyright in all illustrations and written notes in the app.
• Copyright in each photograph belongs to the photographer credited on it.
• You may not copy, distribute, transmit, display, or sell the app's content without permission.
• Any use beyond personal enjoyment requires the operator's prior written consent.

7. Photo submissions

• You may submit a photograph once you have collected the number of cards set by the operator, or if you have supported at any time. The number required is shown on the submission screen in the app.
• The photograph must be one you took yourself. You may not submit someone else's work.
• Copyright in a submitted photograph stays with you. By submitting, you permit the operator to use it as follows:
• publication on the card back and within the app
• making an illustration based on the photograph
• use in promoting the cards
• The display name you choose appears on the back of a card made from your photograph.
• The operator decides freely whether to accept a submission and replies by email within two weeks.
• To withdraw a submission, tell us through Send feedback in the settings; we can act on it up until the illustration is made.
• The following submissions will not be accepted and may be deleted:
• photographs unrelated to plants
• photographs owned by someone else, or whose rights are unclear
• photographs that infringe another person's likeness or privacy
• photographs that break the law or offend public morals

8. Support

• Support is a one-time payment. Auto-renewing support is not offered.
• Payment is made through Google Play or the Apple App Store; payment and refunds follow each store's policy.
• If you have supported at any time, no ads are shown and you may submit photographs regardless of how many cards you have collected.
• Because it does not auto-renew, there is nothing to cancel. Support benefits last for the period set by the store.
• Support is intended to fund creative work. It does not guarantee that any particular card will be made or that any submission will be accepted.

9. Your obligations

You must not:

• copy or distribute the app's content without permission
• reverse-engineer the app or alter its features by improper means
• submit false information or use another person's information
• use the feedback feature for advertising, abuse, or repeated messages
• otherwise break the law or interfere with the operator's provision of the service

10. Advertising

• Ads may be shown in the app.
• No ads are shown to users who have supported at any time.
• The operator is not responsible for dealings with outside services reached through an ad.

11. Limitation of liability

• The operator is not liable for loss arising from events beyond the operator's control, including natural disaster, network failure, or a problem with your device.
• The plant information in the app comes from the artist's observation and reference material. It must not be relied on for safety decisions, including whether a plant is edible or medicinal.
• The operator is not liable for data lost because a user did not back up their record.

12. Governing law and disputes

• These terms are interpreted under the law of the Republic of Korea.
• Disputes relating to use of the service fall under the jurisdiction of the court where the operator resides.
